Resolution of the Government of the Russian Federation: On the procedure for registering radio electronic means and high-frequency devices

Rules for registration of radio electronic means and high-frequency devices

one. These Rules establish the procedure for registration of radio-electronic means and high-frequency devices for civil purposes used on the territory of the Russian Federation and territories under the jurisdiction of the Russian Federation, keeping records of radio-electronic means and high-frequency devices, issuing a certificate of registration to the owner of radio-electronic means and high-frequency devices.

2. The owner of radio electronic means and high-frequency devices means a person who owns these means or devices, on the right of economic management or on the right of operational management or on another legal basis (rent, free use).

3. Registration of radio electronic means and high-frequency devices is carried out by the Federal Service for Supervision in the Field of Communications in order to account for sources of electromagnetic radiation that affect the proper use of radio frequencies (radio frequency channels).

four. Registration is subject to radio electronic means and high-frequency devices provided for by the list approved by the Government of the Russian Federation.

five. These Rules do not apply to the registration of radio electronic means and high-frequency devices of state bodies and organizations used for the needs of state administration, including presidential and government communications, for the needs of the country’s defense, state security and law enforcement, the assignment (appointment) of radio frequencies (radio frequency channels) to which is carried out Ministry of Defense of the Russian Federation and the Federal Security Service of the Russian Federation.

6. The Ministry of Information Technologies and Communications of the Russian Federation establishes the forms of the protocol for measuring the technical parameters of the radiation of radio-electronic means and high-frequency devices and the certificate of their registration.

7. Registration of radio-electronic means and high-frequency devices is carried out upon a written application of the owner of radio-electronic means and high-frequency devices (hereinafter – the applicant).

eight. An application for registration of radio electronic means and high-frequency devices is submitted to the territorial body of the Federal Service for Supervision in the Field of Communications, in the territory of which it is planned to use radio-electronic means and high-frequency devices, indicating:

  • a) the name, organizational and legal form of a legal entity and its location – for a legal entity;
  • b) last name, first name, patronymic, place of residence, data of the identity document of a citizen of the Russian Federation – for individual entrepreneurs and individuals who are not individual entrepreneurs;
  • c) information about the registered radio-electronic device (name, type, series, number, assigned callsign);
  • d) information about the registered high-frequency device (name, type, series, number, operating frequency band, radiation power, installation location).

nine. If, according to the conditions established when allocating a radio frequency band or when assigning (assigning) a radio frequency (radio frequency channel), radio electronic means are planned to be used or operated in the territories of several constituent entities of the Russian Federation, the applicant submits an application to the territorial body of the Federal Service for Supervision in the Field of Communications for place of registration.

10. Attached to the application:

  • a) a copy of the permission to use radio frequencies (radio frequency channels) for radio electronic means (if the presence of such permission is provided for by the legislation of the Russian Federation);
  • b) a copy of a document confirming the fact of making an entry about a legal entity in the Unified State Register of Legal Entities — for a legal entity;
    a copy of the certificate of state registration of an individual as an individual entrepreneur – for individual entrepreneurs;

  • c) a copy of the document on the assignment of the radio station for individual or collective use of the appropriate category – for radio electronic means of the amateur service;
  • d) protocol of measurements of technical parameters of radiation of radio-electronic means and high-frequency devices (except for radio-electronic means of amateur service).

eleven. The territorial body of the Federal Service for Supervision in the Field of Communications no later than 10 days from the date of receipt of the application:

  • a) considers the documents submitted by the owner of radio-electronic means and high-frequency devices and makes a decision on registration of radio-electronic means and high-frequency devices or on refusal to register them;
  • b) enters, in the prescribed manner, information on registered radio-electronic means and high-frequency devices into the database;
  • c) issues to the applicant a certificate of registration or a reasoned notice of refusal of such registration.

12. The grounds for refusal to register radio-electronic means and high-frequency devices are:

  • a) non-compliance of the submitted documents with the requirements established by these Rules;
  • b) failure to submit the documents required for the registration of radio electronic means and high-frequency devices in accordance with these Rules;
  • c) the presence of inaccurate or distorted information in the documents submitted by the applicant;
  • d) inconsistency of the technical parameters of the radiation of radio electronic means and high-frequency devices with the requirements established in the permit for the use of radio frequencies (radio frequency channels), technical regulations and national standards.

13. The validity period of the certificate of registration of radioelectronic devices corresponds to the validity period of the permission to use radio frequencies (radio frequency channels), if such permission is required.

The validity period of the certificate of registration of high-frequency devices, as well as radio-electronic devices, for which no permission to use radio frequencies (radio frequency channels) is required, is 10 years, unless a shorter period is specified by the applicant.

fourteen. The certificate of registration of radio-electronic means and high-frequency devices is a registered document and gives their owners the right to use radio-electronic means and high-frequency devices.

In case of damage or loss of the certificate of registration of radio-electronic means and high-frequency devices, the territorial body of the Federal Service for Supervision in the Sphere of Communications, which registered the radio-electronic means and high-frequency devices, may issue a duplicate of the certificate on the basis of a written application from the owner.

fifteen. Re-registration of radio electronic means and high-frequency devices is carried out:

at the end of the validity period of the certificate of registration of radio electronic means and high-frequency devices – on the basis of an application submitted to the territorial body of the Federal Service for Supervision in the Field of Communications no later than 30 days and no earlier than 3 months before the expiration of the certificate;

when changing the information specified in the application for registration of radio-electronic means and high-frequency devices and in the documents attached to it, change of the owner of registered radio-electronic means and high-frequency devices – on the basis of an application submitted to the territorial body of the Federal Service for Supervision in the Field of Communications no later than 30 days from the day of the occurrence of these circumstances.

Re-registration of radio electronic means and high-frequency devices is carried out in accordance with the procedure established for their registration.

sixteen. The validity of the certificate of registration of radio-electronic means and high-frequency devices is terminated in the following cases:

  • a) expiration of the validity period specified in the certificate;
  • b) termination of the permit for the use of radio frequencies (radio frequency channels);
  • c) submission of a statement from the owner of radio electronic means and high-frequency devices;
  • d) detection of inaccurate data in the documents that served as the basis for the registration of radio electronic means and high-frequency devices.

17. Information about subscriber stations (terminals) that contain radio transmitting devices that do not require registration in accordance with these Rules, and personal data about their owners – subscribers of communication networks are subject to registration by communication operators providing communication services using such radio electronic means.

eighteen. Information about radio electronic means and high-frequency devices and their owners is provided, respectively, by the Federal Service for Supervision in the Sphere of Communications and its territorial bodies or telecom operators providing communications services using radio-electronic means, to state bodies in accordance with their powers in cases established by the legislation of the Russian Federation.

The procedure for submitting the specified information is determined jointly by the interested state bodies, unless otherwise established by the legislation of the Russian Federation.

nineteen. For violation of the procedure for registration of radio electronic means and high-frequency devices established by these Rules, the guilty persons are liable in accordance with the Code of Administrative Offenses of the Russian Federation.
